the bay area, but now found living halfway around the world. and investigators say he may have admitted to his crime on facebook. good evening. thank you for joining us. >> i'm dan ashley, and i'm ama daetz tonight. this suspect originally from saratoga, is being held in held in jail in france. there's been a warrant for him for more than three years now. >> the description of his alleged actions some may find upsetting. authorities say the victim showed them a facebook message from him that said, quote, so i raped you. end quote. abc seven news reporter j.r. >> stone is following the story, joins us live tonight with those details jr. >> umma dan there are certainly still questions out there on why in a digital age like the one that we're seemingly in, it took authorities nearly three years to find this man. nevertheless he is in custody right now. the man blurred out in this photo, 31 year old ian cleary, who was wanted by u.s. marshals, has now been caught in france, according to the associated press. >> he did uh- forced himself on

me and raped me and after he did that, he started crying said, i'm sorry. like i didn't mean to hurt you. i didn't mean to hurt you. did i hurt you? and then i said, yes, he hurt me. >> that is shannon keeler speaking to abc news. three years ago. she said she was raped by cleary in her room after a frat party in 2013 at gettysburg college in pennsylvania. she went to campus police and local authorities, but nothing was initially done and no charges filed. that was until keeler says cleary sent facebook messages to her admitting guilt. police then reopened the case and put out an arrest warrant. cleary is a saratoga native and santa clara university alum who allegedly had been on the run since those messages were made public three years ago. >> it's like you came to terms with that, that he did do it and

his last few messages were, so i raped you. i won't do it to a girl ever again. >> i think the strength of that social media statement is going to carry the day to bring mr. cleary back to the united states and have him set for trial, legal analyst steven clarke says that while it may seem odd that a message appearing to admit guilt was sent, it sometimes happens as people try to make amends. >> keeler told the ap that after the incident, the then district attorney said it was difficult to bring cases when alcohol is involved. clarke, though, says that is no longer how things are done. >> they actually look at as a reason to bring a case because they say that if someone is not capable of consent, you cannot take advantage of them, even if they are intoxicated, clarke says. >> if this case eventually goes to trial, the defense would likely try to question the validity of the facebook messages. you did not see

cleary's picture in that story, as he has not yet officially been charged. his french lawyer appointed to represent him did not return phone messages on tuesday, according to the apa. as to if and when he'll be returned to the united states. that is unknown at this time. i have reached out to multiple departments and agencies in pennsylvania for more information. jr stone, abc seven news. >> what a story jr thanks very much. the encampment at uc berkeley is all packed up this evening after successful talks with the university. the university says they reached an agreement to expedite what it calls a new socially responsible investment strategy. demonstrators say they're going to protest at the uc regents meeting at uc merced tomorrow, as other activists from across the state are doing. uc regents have no plans to sell assets, despite the protesters demand that the universities divest the regents say tonight that the

university system has $32 billion invested in companies that make weapons or support israel. >> it's very complicated, some of them are time commitments that we've made, and the students need to understand that. but we i think we need to do a better job at communicating that. >> at least one committee member says the board should consider protesters demands when looking at future investments. in the meantime, protesters at san francisco state say they've reached an agreement with the university leadership tonight after more than two weeks of their encampment. they say the university has agreed to divest from weapons manufacturers and other similar groups. in the future, they'll give a formal news conference tomorrow on campus about all of this. and in the south bay, a pro-palestinian rally was held at the encampment on the san jose state campus. it popped up yesterday and today the school warned students they need to take the tents down or they could face sanctions. the encampment is right near the statue of tommie smith and john

carlos, who famously protested during a medal ceremony at the 1968 summer olympics. developing news now the fbi and department of homeland security are putting out a warning regarding pride events next month. >> they say foreign terrorist groups like isis could make them a target tonight. they believe this threat is being compounded by the environment here at home. abc seven news reporter tim johns is hearing from the groups that are on high alert. >> it's one of the most lively celebrations in the bay area. every june, our region comes alive with the sights and sounds of pride. >> we want to celebrate that people in san francisco live authentic lives and that we can love who we love. >> but ahead of this year's celebrations comes a new public service announcement from the fbi and department of homeland security. in it, a warning that foreign terrorist organizations like isis could target pride events around the country. cameron pollan works with the fbi's branch here in san francisco.

>> the public service announcement is definitely something new this year, the fbi says. >> as of now, there are no immediate, credible threats here in the bay area. however they are advising people to take precautions beyond the fbi's warnings. san francisco pride executive director suzanne ford says sadly, threats against pride events are nothing new. >> our organization for many, many years has worked with state, local, federal law enforcement agencies and other appropriate agencies to make sure our communities safe. >> the fbi's psa has also gotten the attention of groups like equality california. the lgbtq nonprofit says they want everyone to be comfortable celebrating pride. this year. >> i go with a friend, let people know you're attending pride, have a meet up spot, have an exit plan, know a checkpoint around the area because with pride kicking off in just a few weeks time, ford says this year's celebrations will be better than ever before. >> we're going to come together. >> there's going to be a million people out on market street, and we're going to proclaim to the

world that in san francisco, pride is our community and that we're going to be there in san francisco. >> tim john's abc seven news. >> now to the east bay, where tonight we've learned the date of the recall election for alameda county district attorney pamela price. after a lengthy special meeting today, the alameda county board of supervisors set the date for november 5th. that's the same day as the general election. the registrar of voters supported that date because it would be less complex and not nearly as costly as a special election. the price tag was estimated to be as high as $20 million us. >> time to get ahead on our weather picture for tomorrow. abc seven news meteorologist andy patel is getting us ready in our 24 hour accuweather forecast. sandhya yeah umma, it is good sleeping weather tonight. take a look at these live pictures and you'll see what i'm talking about. >> not so great commuting weather. the fog is causing lowered visibility across parts of the bay area, particularly in

san francisco. so let's take a look at your planner tomorrow morning. when you get going, watch out for dense fog. temperatures in the 50s sunshine will be around the bay and inland by noontime, and it is going to be warmer inland in the afternoon mid 80s there upper 50s coast side. it will get breezy later on in the afternoon and evening. i'll be back to let you know what is changing as we head towards the weekend. coming right up, dan. >> all right, very good. sandy thank you. happening now a city planning meeting is stretching late into the night, hoping to open the door to new farmworker housing in half moon bay. and many, including governor newsom, recently say it's a long time coming. the push comes after last year's mass shooting, the deadliest in san mateo county's history, killed seven workers on multiple farms and exposed the poor living conditions that they are forced to live in. we've been closely following this new housing push in our effort to build a better bay area. abc seven news reporter lauren martinez has more on this next

step. >> supporters to bring a housing project for farm workers packed the planning commission meeting in half moon bay. the plan is to build a five story, 40 unit building here where a house at 555 kelly avenue sits. it's so exciting because they can walk next door if they go to church, or they can walk to the store, belinda hernandez arriaga, director of the group alas, is one of the applicants heading the project. the site would be a mix of housing for senior farm workers and include a resource center. >> i've gone through a mix of emotions, everything from, you know, hope and just worry. >> once the project hit the planning commission for review, it garnered more questions than answers. >> we never really talked about what the resources are. i don't really understand. >> tuesday marked the three hours long meeting the commission discussed and questioned the project, so i'd like to understand what the meaning of local means. >> is it city of half moon bay boundaries for the farms related to the city of half moon bay

boundaries? or does local mean all the farms along the coast side? >> so just just reassure me that your financing is not going to fall apart. >> the questions we're asking are not about the importance of these services. >> we're trying to understand the land use. that's where we're going. >> on thursday, governor gavin newsom threatened potential legal action against the half moon bay planning commission. calling for a delay to vote is egregious. his support behind this specific project was huge for the applicants. >> it really falls in line with his promise he made to our farmworkers about a year and a half ago, when he came and met with them after the tragedy and said he was here, committed to housing, committed to better change. >> before the meeting, we heard from half moon bay residents maria carrillo and her sister martina on why this project is needed in such an expensive area. >> yo tengo aqui desde la martina has lived in the area since 1984, and she's always had to share a living space with her

san francisco unified school district tonight, and since there are just a few more weeks before the end of the year one. see the lidar lidar says these allegations simply cannot wait. emotions running very high tonight at the san francisco unified school district's meeting, where the naacp held a rally. it says a number of black students have experienced racist incidents. a girl recounted one of her experiences, including classmates using racial slurs. >> there was this fourth grader i wanted to play with her really badly because she was like, really popular, and she said, sorry, i can't play with you

because of your skin color. my god. >> the group went inside and briefly interrupted tonight's meeting. the superintendent put out this statement. it reads in part, quote sf usd takes reports of racism very seriously, and we encourage anyone who is a victim or witnesses such behavior to report it to a trusted adult at school. when we learn of a concern, it goes on. we take immediate steps to investigate, educate, assign consequences depending on the outcomes of the investigation, and work to repair the harm. using restorative practices, a group of eight tiktok content creators filed a lawsuit today against the federal government to block a potential ban of the app. >> the suit argues. the new law threatens free expression. tiktok is paying for the group's legal fees and filed its own lawsuit. legislation passed last month bans the video app in the u.s. unless it's sold in the next 12 months. it's in response to concerns that tiktok's ties to china could expose americans personal information to the chinese government. new details

in the rush to get highway one back open near big sur, the governor's office says the road will finally reopen this week, a month and a half after storms eroded the southbound lane, part of the highway crumbled into the ocean back in march, cutting off the route between carmel and big sur. after weeks of work by caltrans, it will now be ready for drivers starting at 6:30 a.m. friday morning. >> governor newsom is on his way to the vatican to talk about the fight against climate change. politicians and researchers from around the world will attend a three day conference. newsom is one of the four u.s. invitees alongside other world leaders. they intend to sign a new international protocol, which will be submitted to the united nations. >> sage, the miniature poodle, has won best in show at the annual westminster dog show. sage beat out more than 2500 other dogs of more than 200 breeds for the top prize. this is the fourth time a miniature poodle has won best in show, as gloria says, it sounds the best in show winner only gets a

trophy, no cash prize, not even a lifetime supply of kibble. i know right? nothing. >> surely. maybe a few extra treats or some hope. well good job. yes. all right, let's talk about our weather. >> abc seven news meteorologist andrea patel is here. sandhya. yeah. >> and dan and omar, our weather looks fantastic, but get used to what you're seeing here right now. a live view from our exploratorium camera, and we've got the fog in it is obscuring. sort of the top views of san francisco's skyline. areas of dense fog. this is your travel hazard in the morning. reduced visibility. so definitely drive slowly. fog will last until mid morning. this was a time lapse view from our golden gate bridge camera tonight, and you can see how the visibility has been fluctuating. three miles right now in half moon bay, four miles in petaluma. this is why you will need to allow yourself a little extra time for the commute. fog. is there not just near the coast, but it's already moved across the bay and it's headed into some of our valleys as well. here's what happened today. area of low pressure kept our temperatures at or slightly above average, but it certainly

triggered some thunderstorms in the sierra. this area of high pressure is going to nudge in a little bit, and as it does, temperatures are going up, but not everywhere. the coast will remain about the same as today. your numbers right now, anywhere from the 50s to the 60s, unless you're up towards lakeport live view from emeryville looking at the port of oakland. also, gray skies there overnight tonight, areas of heavy fog tomorrow, a little warmer bay and inland. and for the rest of the week, we're talking about breezy conditions with a gradual cooling trend. all right. it is wnba newest team, the golden state valkyries. and it's going to be nice weather for the block party on saturday at 2:00. we're looking at temperatures in the low to mid 60s, a mix of a little bit of fog and a lot of sun out there. we will certainly have a lot of fog tomorrow morning at 5 a.m, even some drizzle. it pulls back towards the coast at noontime, but notice the coast doesn't completely clear. so it's almost like a summer, like pattern where the fog stays put near the beaches. your temperatures first

thing in the morning, 40s and 50s. once again, watch out for that fog tomorrow afternoon. you're looking at highs that will range from upper 50s in half moon bay to the mid 80s inland. if you want sunshine away from the coast, you're going to see plenty of it tomorrow. here's a look at the accuweather seven day forecast. your morning fog giving way to a milder day inland. wide range of temperatures for your thursday. but notice those temperatures are slowly coming down as we head towards the weekend. by sunday, upper 70s inland, upper 50s coast side and then pretty much close to average early next week. but we don't have any extremes in the forecast and no heat coming
