6:05 pm
it was an accurate yes they say will -- was it a lie which he said i don't know i've would characterize it as a lie. i would say it's inaccurate after more more back and forth he finally admitted, yeah, okay it was untruthful if you want to call it a lie i will call it a lie. that liberal new york city jury must have been impressed with that exchange we have even more obvious occasion with his attorneys asking him if he openly pushed for trump to be locked up he said yes probably and ensure that was his answer i think the t-shirt maybe featuring donald trump behind bars maybe that gives it away. cohen also admitted you mentioned trump in every single podcast he records from friday's a week while he claims to remember all details from conversations that he had with trump going all the way back to the 2016 when asked about leaks
6:06 pm
to cnn about the case in 2023 he responded conveniently i don't recall. why is that important? he is the only witness backing up the erie not law but erie that trump himself classified an nda payment as illegal for expense another state of new york is asking jurors to take cohen at his word which is laughable but regardless of the testimony artifact them how labeling a payment to a lawyer as legal expense would be a crime and again nondisclosure agreements they are not illegal for and by the way the nda is not even an issue in dispute in the case nobody is disputing it happened. for the phantom secondary crime he's using to up charge what is a 7 year old misdemeanor whose statute of limitations expired to a felony. nobody really knows what the

crime really is the prosecution barely even brought about much less proved guilt beyond a reasonable doubt. the strategy is clear hoping a lot of relevant immaterial salacious testimony and hatred of trump in new york city would be enough to convict him. so do you see what's happening here no crime and no evidence of any crime and so-called witnesses are pretty much clowns with major credibility concerns with the prosecution asking a jury to convict donald trump simply because he's donald trump asking a liberal new york city jury if road justice to the wind and make a political decision and the judge political himself he's the guy who donated to joe biden nest we've gone over these connections with his family and the conflicts of their he should have recused himself and is allowing this kangaroo court to play out. billing just read the

6:13 pm
really shown throughout his life that he will only tell the truth if he is no alternative they think is the most amazing thing today is the prosecutor said they would close the case rest of their case after cohen's testimony is done there is a problem though nobody has established an element of any crime. the government is not even stated or explained why listing these payments as legal expenses is not correct they haven't put on any material evidence to support those elements. most judges would be insulted for prosecutors to say that's a wrap without ever making a basis for a case so the judge will have this motion for this a verdict and i think anybody in good faith would grant the motion if he sends it to the jury is sending a case to a jury were no crime was stated and
6:14 pm
even core factual issues remain very much and do i still cannot figure out not only what the crime was brought the misdemeanor i can't figure out what the government's arguing as to how this should have been denoted it not for illegal for expense what's the notation they should have put in a ledger none of us know as that's what the cases they expect the judge to do the same. >> sean: i don't think they'd go thumb motion but agree with your analysis as right now you don't have attorney-client privilege as you say he didn't make the case we rest or do point out no crime is been laid out in the court no evidence of crime a lot of salacious
6:15 pm
material moving forward in a lot of words used conspiracy and where did donald trump, where is the where's the evidence he committed the crime but would you do as they are confined to the parameters on the cross is able to a redirect depending what they use that for i would be very cautious not to do it was suggested at the end of the proceedings today if that's a late thursday i wouldn't want to give the government the chance to go over a long weekend and then do a redirect that's a lasting they really see as its win were you have to either finish early as we can go a bit
6:16 pm
long as 1 witnesses cohen's prayer attorney they gave very damning evidence against cohen another would be an expert witness to say this is illegal for expense. paying it was put money to settle a dispute in a nda my inclination right now would be to put it to rest. this case is gone to me they didn't state a basis for a crime they might for all their judgement out the window might be blinded by who the defendant is and i'm hoping he's better than that unless that redirect
6:17 pm
goes badly. so want to give a modicum of faith to him also to the jury right. it's hard for me to believe they aren't equally insulted by what we saw today. >> sean: i wish i had the confidence you do i just don't efface a new york city jury but i have a faith in you. next gregg jarrett and harvard law professor we start with alan tonight your take on today's extravaganza show we call it? >> as much as i love jonathan i disagree. i don't believe the judges better than that he's exactly what he appears to be, biased and frankly incompetent but as for today cohen 2 faced
6:18 pm
duplicitous comes to court dressed up in a nice suit. is calm labor acting polite under coaching from prosecutors of course but he concealed typical venom and hatred all the con job at the tiktok videos expose the real michael cohen is in these lunatic rants and you showed 1 of them he's raging that trump belongs in a cage like a. [ bleeps ] animal and other despicable tirades i hope the jurors are allowed to see those videos over and over again because it's so consistent with everybody else's description of michael cohen believe. no morals of course he's a chronic liar went to prison for perjury but alvin bragg is so desperate that he is willing to put a known also fire and the stage and they know cohen is
6:19 pm
going to lie he wants him to lie and begging on the hope that jurors will hate trump more than cohen and forget about the facts and forget about the law which does not support a conviction. this really is a trial travesty. >> sean: let me ask you professor as you've been involved in a lot of high-profile cases in your incredible career. what advice would you give a trump legal team now. they will finish the cross-examination of cohen thursday and then went to they put on the defense or do they let it go? make that motion that jonathan talked about? >> i would cross-examine them extensively about the prayer -- purple terry session with prosecutors regarding a recording of his own client.
6:20 pm
i'd like to know what precisely they told him, did they give him advice is out of spin the story and going over all of the advice he got from the lawyers would be asking him questions he's not prepared to answer and if he answers any falsely under new york law the prosecutor must stand up and correct the record in front of the jury so what i would do is focus a very hard on that perjury because clearly he lied when he said the reason he recorded his own client donald trump was to protect donald trump and david packer if you're going to protect donald trump asking permission tell him you are recording but he surreptitiously recorded. what happened when he told the prosecutor that did the prosecutor say oh my god you have to come up with a good reason for this what reason did he come up with. i want to know what information,
6:21 pm
advice prosecutors gave cohen because he is slick and appears in front of the jury is somebody prepared to testify from his own memory but if the jury learns all of this is a subjective preparation that his testimony was changed by the prosecutor it puts a different light on how his testimony is perceived once cross-examination is over i would try very hard to put on experts. judges ruled against that but i would push it hard particularly experts on federal election law and state election law because the judge doesn't know anything about those issues and if they could testify there was no violation of federal election law there goes the second crime. the judge may keep that out but that's the kind of thing that would result in a error so i don't think they would arrest
6:22 pm
they need to put on expert witnesses. >> sean: i agree what was effective to me in court today is michael cohen all relaxed and prepped i would like to know how many times did he spend prepping with prosecutors how many sessions took place i want to know everything up to this moment in the relationship between prosecutors and michael cohen because the michael cohen they showed on tape today was not exactly the guy the jury heard and saw today in the courtroom. >> the problem is cohen isn't pleading amnesia about all that. he said geez i don't remember about being coached. >> sean: he seems to remember 2016 he said i don't remember anything. >> sean: remember everything in 2018. >> he never tells the kurt truth.
